The Arizona State Board for Private Postsecondary Education (“State Board”) does not require licensure of distance education programs as long as there will be no physical presence in Arizona, as defined by A.R.S. § 32-3001(5). 

Colorado is currently a state that relies on physical presence for authorization. For those institutions that do not trigger a presence, enrollment of Colorado residents is permitted without formal authorization. There is no exemption language, the law and policy simply reflect that the authority of the Degree Authorization Act covers those institutions that are legally operating in Colorado. 

There is no physical presence trigger. Therefore, there is no need to pursue licensure from the Commission for Independent Education at this time.

Institutions with no physical presence in Idaho do not need to register. Although our regulations’ definition of “physical presence” is broad, institutions whose programs are offered strictly online do not need to register because they have no physical presence in Idaho.

In response to your online request submission #725059 pertaining to an

exemption for distance education programs. Based on this correspondence, the

institution meets the description of an Institution with Limited Physical Presence in

Illinois as defined under 23 Illinois Administrative Code Section 1030.10.

The programs proposed by ºÃÉ«App at Redding, California are of a sufficiently religious nature that no further authorization from the Board for Proprietary Education is needed at this time. Should any changes in the institution’s course offerings occur, the Board should be notified before their implementation. At that time a further review of the institution’s status will be conducted.

Based upon the institution’s certification that the institution will not engage in any operating or soliciting activities per 13 KAR 1:020 Section 1(9)(a)-(e), licensure with our agency is not required at this time.

LA. R.S. 1808 does not apply to ºÃÉ«App. There is no formal exemption registration for out-of-state institutions to which the law does not apply.

There is currently no formal application or fee associated with exemption; this is under review by the Department.

As ºÃÉ«App is only offering distance education in Missouri, the institution does not need to be certified to operate in Missouri.

Nebraska does not require degree-granting institutions that offer strictly online courses or programs to seek approval from this agency. Therefore, there is nothing more for ºÃÉ«App to do. There is no registration or fee.

Based on the information attested to above, the training provider/postsecondary educational institution described above is not required to be licensed in Nevada by the Commission on Postsecondary Education. Any change to the five statements above automatically rescinds this authorization and the institution must reapply.

With no physical presence in New Hampshire, there would be no need to seek administrative approval because the institution would be exempt from Higher Education Commission jurisdiction.  ºÃÉ«App is welcome to offer distance education programs in a fully online modality (meaning there would be no internships/practicums/field experiences associated with these programs, as these would establish physical presence).

ºÃÉ«App does not need to submit payment or documentation if the institution does not trigger physical presence in Ohio. The Ohio Department of Higher Education doesn’t specifically issue institutional exemptions. 

As established by 34 CFR Section 600.9, out-of-state institutions that offer post secondary degree-related distance education in another state must meet any of that state’s requirements to do so legally. 

Currently, Oklahoma has no such requirements in place for degree-granting institutions. Out-of-state institutions do not require Oklahoma authorization to offer online-only degree-related distance education in Oklahoma.

If ºÃÉ«App will not have a physical presence in Pennsylvania, nothing further is required. Please note that PA does not provide letters of exemption, religious or otherwise. 

The Commission does not require licensing of institutions that enroll residents of South

Carolina into online or distance education programs unless the institution operates or

solicits in South Carolina in such a way that creates a physical presence. The participation

of an institution in SARA does not supplant the requirement for licensure to operate or

solicit in SC.

South Dakota does not require authorization for online courses. 

ºÃÉ«App is not providing a physical presence in Tennessee at this time, which means there is no oversight offered by Tennessee Higher Education Commission (THEC).

ºÃÉ«App, accredited by TRACS, a THECB-recognized / U.S. Department of Education-recognized accreditor, has stated that it offers or intends to offer online programs to Texas residents.  As ºÃÉ«App has indicated only offering 100% online education to Texas residents, at this time, THECB has no oversight of the institution.

No verification for exemption at this time.

If the programs offered by a postsecondary institution, are only offered online with no physical presence in Vermont, the entity does not need to be approved by the Vermont State Board of Education. 

1. The institution does not have and does not intend to have a physical presence in Washington State, which can include a branch campus, administrative office, or use of a Washington-based address and/or telecommunications number; and

2. Your institution does not conduct and does not intend to conduct local advertisements and

3. recruitment in the state that would specifically target Washington residents, such as ads in local media or a recruiting agent based in the state; and

4. The distance learning degree programs offered by your institution do not include a component in which the student is required to complete an internship, externship, clinical training, etc. at a location in Washington State.

On that basis, it is the determination of the Washington Student Achievement Council that

authorization by our agency is not required.

Based on information provided by ºÃÉ«App to the West Virginia Higher Education Policy Commission, ºÃÉ«App does not meet the definition of physical presence as defined in Series 20, Initial Authorization of Degree-Granting Institutions. Since physical presence has not been established, authorization is not required.

ºÃÉ«App’s application has been reviewed and approved. ºÃÉ«App is authorized to offer educational services to Wyoming students starting July 1, 2024. The registration expires June 30, 2025,
